SeptiQuote Terms of Service
Effective date: July 30, 2026
These Terms of Service ("Terms") govern use of SeptiQuote (the "Service"), a web-based quoting and invoicing platform operated by Six Plum, LLC, a Texas limited liability company ("SeptiQuote," "we," "us"), located at 906 Junction Highway, Kerrville, TX 78028. By creating an account or using the Service, you agree to these Terms on behalf of yourself and the business you represent ("you," "Customer").
1. The Service
SeptiQuote provides software for creating quotes, collecting electronic signatures, generating invoices, and tracking payments for service businesses. We may improve, modify, or add features at any time. We will not materially reduce the core functionality you pay for during a paid term without notice.
2. Accounts and Responsibility
You must provide accurate information when registering. You are responsible for all activity under your company's accounts, for maintaining the confidentiality of login credentials, and for the actions of team members you invite. You must be at least 18 and authorized to bind the business you register.
3. Subscriptions, Trials, and Payment
- Free trial. New accounts receive a 14-day free trial. No payment method is required to start.
- Paid plans. After the trial, continued use requires a paid subscription (currently $[99]/month, or annual plans where offered). Prices are stated before you subscribe. We may change prices with at least 30 days' notice; changes apply at your next billing cycle.
- Billing. Payments are processed by Stripe. By subscribing you authorize recurring charges to your payment method until you cancel.
- Cancellation. You may cancel anytime from the billing page. Cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable, but you keep access through the period you paid for.
- Nonpayment. If payment fails, we may suspend access after reasonable notice. Your data is retained per Section 6 even while access is suspended.
4. Your Data
- You own it. All customer records, quotes, invoices, signatures, price books, and other content you or your signers submit ("Customer Data") belong to you. We claim no ownership.
- Our license. You grant us a limited license to host, process, transmit, and display Customer Data solely to provide the Service (including sending quote and invoice emails on your behalf).
- Export. You may export your data at any time using the Service's features, and may request a data export within 30 days after account closure.
- Your responsibilities. You are responsible for the accuracy and lawfulness of Customer Data, including having the right to enter your clients' contact information and to send them communications through the Service.
5. Electronic Signatures
The Service enables recipients to accept quotes electronically. You are responsible for determining whether electronic acceptance is appropriate and enforceable for your transactions in your jurisdiction. We store signature records (including signer name, drawn signature, and timestamp) as part of Customer Data but do not guarantee the legal enforceability of any signed document.
6. Data Retention and Deletion
If your account is closed (by you or by us), we will retain Customer Data for [60] days so you can export it or reactivate, after which we may permanently delete it. We may retain minimal records as required for legal, tax, or accounting purposes.
7. Templates Are Not Legal Advice
The Service includes sample text (such as quote terms, waivers, and lien-notice placeholders). These are provided for convenience only, are not legal advice, and must be reviewed and adapted by you and your attorney for your business and state. You are solely responsible for the legal content of your quotes and invoices.
8. Acceptable Use
You agree not to: use the Service for unlawful purposes; send spam or unlawful communications through it; upload malicious code; attempt to access other customers' data or probe or circumvent security or billing controls; resell the Service; or use it to build a competing product. We may suspend accounts that violate this section, with notice where practicable.
9. Availability and Support
We aim to keep the Service available at all times but do not guarantee uninterrupted operation. Planned maintenance and factors outside our control (including third-party providers) may cause downtime. Support is provided by email at support@septiquote.com during reasonable business hours.
10. Third-Party Services
The Service relies on third-party providers, including Stripe (payments), Supabase (hosting/database), and Resend (email delivery). Their availability and terms are outside our control.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT DATA WILL NEVER BE LOST — MAINTAIN YOUR OWN RECORDS OF CRITICAL DOCUMENTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR REVENUE; AND (B) OUR TOTAL LIABILITY ARISING OUT OF THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. THESE LIMITS DO NOT APPLY TO YOUR PAYMENT OBLIGATIONS OR EITHER PARTY'S WILLFUL MISCONDUCT.
13. Indemnification
You will defend and indemnify us against third-party claims arising from Customer Data, your use of the Service in violation of these Terms, or your transactions with your own clients.
14. Termination
You may stop using the Service at any time. We may terminate or suspend accounts for material breach of these Terms (including nonpayment) with reasonable notice where practicable, or immediately for serious violations (e.g., security abuse, unlawful use). Sections 4, 6, 7, and 11–17 survive termination.
15. Changes to These Terms
We may update these Terms. For material changes we will give at least 30 days' notice by email or in-app notice. Continued use after the effective date constitutes acceptance.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflicts of law. The parties will first attempt to resolve disputes informally. [Any dispute not resolved informally will be resolved in the state or federal courts located in Kerr County, Texas, and the parties consent to their jurisdiction.] (Alternative: binding arbitration clause — discuss with your attorney.)
17. Miscellaneous
These Terms plus any order or checkout page are the entire agreement. If any provision is unenforceable, the rest remain in effect. We may assign these Terms in connection with a merger or sale; you may not assign without our consent. Notices to us: contact@sixplum.com or the address above.
